Camera systems and manual entries aren’t perfect. Wrong number-plate reads, cloned plates and sold vehicles all lead to wrong challans. You have the legal right to contest. Here’s how.
Valid Grounds to Contest a Challan
- Wrong vehicle – number read incorrectly by camera
- Cloned number plate – another vehicle using your number
- Vehicle sold before the challan date
- Vehicle at another location at that time (with proof)
- Photo evidence doesn’t match your vehicle type or colour
- Emergency – e.g. making way for an ambulance
- Duplicate challan for the same offence
Evidence to Collect
| Ground | Useful evidence |
|---|---|
| Wrong vehicle / cloned plate | RC copy, photos of your vehicle, challan photo comparison |
| Vehicle sold | Form 29/30, sale letter, buyer details |
| Vehicle elsewhere | Toll receipts, FASTag history, GPS, parking receipts |
| Emergency | Hospital records, witness statements |
Option 1: Grievance With Traffic Police
For challans still pending with the police, raise a grievance on the Delhi Traffic Police website or the e-Challan portal with your evidence. Keep the complaint number.
Option 2: Contest in Virtual Court
If the challan is in the Virtual Court, choose not to pay the proposed fine and opt to contest. The matter then goes to a regular court.
Option 3: Contest in Regular Court
When a case is in court, you (or your advocate) can appear, present evidence and request that the challan be set aside. Courts consider documentary proof seriously.
Tips for Success
- Don’t pay a challan you plan to contest – payment is often treated as acceptance.
- Act early, before summons and transfers pile up.
- Keep both printed and digital copies of evidence.
- If plate cloning is suspected, file a police complaint.
When to Hire an Advocate
If the challan is in court, involves high fines, or you’ve received a summons, an advocate can draft the reply and appear for you. Related: challan on a sold vehicle and court notice for traffic challan.
